Welcome to AirlinesUp (“AirlinesUp”, “we”, “our”, “us”). This website (the “Site”) is provided solely to assist customers in gathering flight information, determining the availability of flights, making legitimate flight reservations, and transacting business with airlines.

By using the Site, whether to review information or to book flight reservations, you agree to these Terms & Conditions and agree they control any flight reservations made with us. Please read these Terms & Conditions carefully. They contain a mandatory arbitration clause, limitation on damages, limitations on class actions, and waiver of jury trial among other things.

BY ACCEPTING THESE TERMS, YOU ARE AGREEING TO THE MANDATORY ARBITRATION AND CLASS ACTION WAIVER CONTAINED BELOW.

If you do not agree with any part of these Terms & Conditions, you must not use the Site or book flight reservations with us. We reserve the right to amend these Terms & Conditions at any time without prior notice. Your continued use of the Site following the posting of changes will mean you accept those changes.

General Disclaimer

AirlinesUp does not act as principal but simply makes arrangements with airlines for flight booking services. We act as an intermediary between travelers and airlines.

By using this Site, you acknowledge that the rates offered by AirlinesUp include certain fees retained by us for services, taxes and other charges. When booking with any airline through this Site, you authorize AirlinesUp to book reservations on your behalf for the total price displayed.

You acknowledge and agree that AirlinesUp shall have no liability to you for errors or inaccuracies on the Site, or for any failure of any kind by airlines from whom you obtain flight services through this Site. AirlinesUp does not endorse, guarantee or insure the products or services provided by airlines.

Safe Shopping Guarantee

AirlinesUp values your trust. We seek to use reasonable organizational, technical, and administrative measures to protect your personal information. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure.

If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please immediately notify customer service at +1 437 255 3721 or info@airlinesup.co.

Booking Process

In order to complete a booking, the following steps must be taken:

  • When we place flight services on our Site, we are inviting you to make an offer for their purchase.
  • You make an offer when you press “Book” on the payment page. This offer cannot be withdrawn if you change your mind.
  • Our email confirmation is NOT contractual acceptance of the booking, but merely an acknowledgement that we have received your offer.
  • The contract is formed when payment in full has been received and confirmed by the airline.
  • Once you have completed the booking, you can only cancel or change details at our sole discretion and in accordance with these Terms & Conditions.

At all times throughout your trip, a government-issued photo ID is required for security checks. For international travel, proof of citizenship (Passport) is required. It is your sole responsibility to ensure that you meet passport, visa, and health requirements.

Pricing, Taxes, and Fees

Our total prices include all taxes and fees applicable to your booking, unless stated otherwise. Additional charges may apply:

  • Service fees: AirlinesUp charges a service fee per passenger, per ticket. The amount varies based on the type of booking.
  • Additional charges by suppliers: Baggage fees, seat selection fees, fuel surcharges, and other supplier charges are paid directly to the airline.
  • Payment must be made in full with a valid credit or debit card at the time of booking.

Our Service Fees

In addition to airline costs and fees, AirlinesUp charges service fees as follows:

Post-Ticketing Fees

Changes, cancellations, and special requests after booking may incur additional fees:

These fees are in addition to any airline-imposed fees and charges.

Cancellations and Refunds

Most airline tickets and service fees are non-refundable after 24 hours of booking. All cancellations must be done by contacting customer service.

We can accept refund requests only if:

  • You have applied for cancellation and the fare rules provide for refunds
  • You are not a “no show” (no-show bookings are ineligible for refunds)
  • We are able to secure waivers from airlines to process the refund

Refund processing may take 30-90 days from receipt of your request to receiving credit on your statement. Our booking fees for the original reservation are not refundable.

Airline Schedule Changes and Cancellations

Airlines may make changes to flights due to operational needs. Types of changes include flight number changes, time changes, routing, date changes, and cancellations. These changes are made by the airline and are outside of our control.

We will attempt to notify you of any schedule changes. We recommend contacting the airline to reconfirm your flights within 72 hours of departure. AirlinesUp does not assume any liability for cancelled flights, missed flights, or flights not connecting due to schedule changes made by airlines.

Baggage Policy and Fees

Most airlines charge baggage fees, even for the first checked bag. Baggage fees range from $15 to $200 or more depending on size, weight, and airline. These fees are paid directly to the airline.

When connecting flights involve multiple airlines, you may need to reclaim your bags at the connecting airport and check in again. Excess baggage fees will be assessed by each airline separately.

Limitations of Liability

Please read the following carefully as it sets out the limits of our liability to you:

  • The information on the Site is provided on an “AS IS” and “WHERE AVAILABLE” basis. We make no warranties, express or implied, regarding accuracy, timeliness, or completeness.
  • We are not liable for any damages to your computer equipment, loss of data, or viruses on account of your access to or use of the Site.
  • We are not liable for any injury, loss, claim, damage, or special, punitive, exemplary, direct, indirect, incidental, or consequential damages arising from use of the Site or flight reservations booked through AirlinesUp.
  • Our aggregate liability shall not exceed the total charges set forth in the itinerary giving rise to such liability.
  • Any claim must be brought within one hundred eighty (180) days from the date such claim arose or accrued.
  • We are acting only as an intermediary for airlines and are not liable for their products and services.

Resolution of Disputes and Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS AND WILL HAVE A SUBSTANTIAL IMPACT ON HOW CLAIMS ARE RESOLVED.

Before taking any other action, you must first contact us at +1 437 255 3721 or info@airlinesup.co so we have an opportunity to address your concerns. We shall have 60 days to try to resolve your issues.

Waiver of Trial by Jury and Class Actions

YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS AND CONDITIONS, WE ARE EACH AGREEING TO BINDING ARBITRATION OF ANY DISPUTES, WAIVING THE RIGHT TO A TRIAL BY JURY. WE ARE ALSO EACH WAIVING THE RIGHT TO PARTICIPATE IN A CLASS, MASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION.

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, exclusive of conflict or choice of law rules. Unless otherwise prohibited by applicable law, any claim must be brought within one hundred eighty days (180) from the date on which such claim arose.

Site Usage and User Obligations

You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement. If you are making flight reservations for another person, you agree to inform that person about these Terms & Conditions.

You warrant that all information supplied by you is true, current, complete and accurate. Any exploratory, speculative, false, or fraudulent reservation is prohibited.

Prohibited Activities

You agree that you will not:

  • Use the Site for any commercial purpose without our written permission
  • Access, monitor, or copy content using robots, spiders, scrapers, or other automated means
  • Modify, copy, distribute, transmit, display, or create derivative works from the Site
  • Use any device or software that interferes with the normal operation of the Site
  • Introduce viruses, trojans, worms, or other malicious material
  • Attempt to gain unauthorized access to the Site, servers, or databases

We reserve the right to cancel your account and terminate your use of the Site if you violate any of these prohibitions.

International Travel Requirements

All customers are advised to verify travel documents (passports, visas) for countries they are visiting or transiting through. Reliable information can be found at www.travel.state.gov.

AirlinesUp will not be responsible if proper travel documents are not available and you are denied entry or transit. Your transaction does not guarantee entrance to any country.

Many countries require that your passport be valid for a minimum period from the date of arrival. Contact the local consulate for specific requirements.

Privacy and Data Protection

Please review our Privacy Policy, which governs your visit to this Site. The Privacy Policy provides a description of how we protect and use your personal information.

By using our services, you authorize us to carry out verification checks to confirm your identity. Personal information may be disclosed to registered credit reference agencies, which may keep records. This process does not perform a credit check and will not affect your credit rating.

Severability

If any provision of these Terms & Conditions is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

Entire Agreement

These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and AirlinesUp concerning your use of the Site and services. This agreement supersedes all prior agreements and understandings.
